Eastman Software, Inc., a Massachusetts corporation, sued Texas Commerce Bank, National Association for $250,000.00 (plus attorneys fees, interest, and court costs) for its alleged wrongful dishonor of a standby letter of credit given in favor of Eastman. Eastman contended that, notwithstanding its presentation of proper sight drafts and documents as required by the letter of credit, and the existence of $250,000.00 remaining to be drawn, Texas Commerce wrongfully refused to pay that amount.
